Terms and conditions of participation
1 Austrian Airlines „Christmas Competition”
1.1 By participating in the „Christmas Competition“ (hereinafter referred to as the „Promotion“), you confirm that you agree to these Terms and Conditions of Participation.
1.2 The organizer of the promotion is Austrian Airlines AG, Office Park 2, P.O. Box 100, A-1300 Vienna Airport (hereinafter referred to as „Austrian Airlines“). Participation in the promotion is free of charge and in no way dependent on the purchase of a good or the use of a service.
1.3 The prize draw period is from 22nd of December 2023 to 7th of January 2024. The winners will be notified on 10th of January 2024 at the latest.
1.4 The competition is governed exclusively by Austrian law.
2 Participation
2.1 Natural persons who are 18 years of age or older and reside in Austria are eligible to participate.
2.2 Employees of Austrian Airlines or employees of agencies working for Austrian Airlines are excluded from participation. Family members of these persons are also excluded. Automated entries as well as deliberate false entries and entries with false profiles are not permitted.
2.3 In order to participate in the raffle, the participant must register for the competition and agree to the terms and conditions of participation.
2.4 Austrian Airlines reserves the right to change the conditions of participation at any time.
3 Determination of the winners
3.1 The winners will be determined in a non-public draw after the closing date for entries.
3.2 If the winner is not available or cannot be contacted by normal means, an alternative winner will be selected.
3.3 The winner will then be notified by e-mail.
4 Prizes
4.1 The following prize will be raffled: 1×2 tickets from Vienna to Sevilla with Austrian Airlines in Economy Class. The flights depart exclusively from Vienna. Connecting flights to or from Vienna in order to start or end the trip are not included in the prize.
4.2 The prize will be sent to the winner by e-mail in the form of a flight voucher valid for one year.
4.3 Cash redemption or alternatives to the prize offered are not possible. The prize is not transferable and the resale of the tickets is not permitted. The promotion cannot be combined with other Promotions.
5 Exclusion of liability
5.1 Austrian Airlines shall not be liable in any form whatsoever for direct or indirect damages in connection with the implementation of the prize draw, resulting from participation or the possible non-availability of the Internet server. In particular, Austrian Airlines shall not be liable for the loss, delay, alteration, manipulation and/or misdirection of e-mails and/or data during data entry, collection, transmission and/or storage, which have their cause in third-party data networks, in particular the Internet or the WWW, in third-party telephone lines and/or other hardware and/or software of the participants and/or third parties; this also applies in particular to faulty, missing, interrupted, deleted or defective data. Austrian Airlines shall also not be liable for incorrect information caused by participants and/or third parties, their hardware and/or software and used for or in connection with the competition. In particular, no liability shall be assumed if e-mails or data entries do not comply with the requirements set forth therein and are consequently not accepted and/or accepted by the system. Furthermore, Austrian Airlines shall not be liable in the event of theft or destruction of the systems and/or storage media storing the data or in the event of unauthorized modification and/or manipulation of the data in the systems and/or on the storage media by the participants or third parties.
5.2 Austrian Airlines reserves the right to cancel or terminate the competition at any time without prior notice. This applies in particular if the competition cannot run as planned for any reason, such as software and/or hardware errors and/or other technical and/or legal reasons that affect the administration, security, integrity and/or regular and proper execution of the competition. In such cases, Austrian Airlines shall also have the right to modify the Sweepstakes at its discretion.
5.3 Austrian Airlines shall not be liable for the acts or omissions of third parties.
5.4 Austrian Airlines shall only be liable for damages – irrespective of the legal grounds – in the event of intent or gross negligence on the part of Austrian Airlines, its legal representatives or vicarious agents, as well as in the event of culpable breach of essential contractual obligations.
6 Use of data
6.1 In accordance with the statutory provisions, each participant has the right to obtain information from the data controller about the personal data concerned, as well as the right to rectification, deletion or restriction of processing or the right to object to processing, as well as the right to data portability. To exercise these rights, please use our data subject rights contact form. Consent to the processing of personal data can be revoked at any time and without giving reasons. The revocation does not affect the lawfulness of the processing that was carried out on the basis of the consent until the revocation. By revoking the consent via the e-mail address online@austrian.com or via the fax number +4351766512672, the participant withdraws from participation in the competition.
6.2 Participants expressly agree that their personal data such as title, first and last name, e-mail address may be processed and stored by Austrian Airlines (as the responsible party) until 10th of January 2024 and its processing for the purpose of carrying out the prize draw. For the processing of the data, Austrian Airlines uses the following commissioned data processor: Oracle Corporation, 500 Oracle Parkway, Redwood Shores, CA 94065.
7 Miscellaneous
7.1 Should one or more of the above provisions be or become invalid, this shall not affect the validity of the remaining provisions. The invalid provision shall be replaced by a provision that comes closest to the invalid provision in terms of its economic purpose. The same shall apply in the event of a loophole requiring regulation.
7.2 Legal recourse is excluded. There is no enforceable claim to the payment of the winnings.
